Successful blockage of a mobile app on Google Play
Our team recently succeeded in getting an infringing mobile game app removed from the Google Play store in the Russian Federation.
The grounds were:
- infringement of exclusive trademark rights
- copyright infringement (the app borrowed key elements of the original board game)
We prepared and filed two different types of complaints - for each of the violations. As a result - the app was blocked.
An interesting detail: at first Google refused to satisfy the complaint about the trademark. We filed an appeal, explained our position in detail, added arguments and evidence - and after that Google recognised the validity of the claims.
This case shows:
-
It is indeed possible to get an application blocked in Google Play, even despite the initial refusal
-
Argumentation, evidence and legal persistence matter
-
Board game rights can be effectively defended not only on marketplaces, but also in the realm of digital products
We continue to work on blocking the app on the App Store as well.
